Terms of Service - SuperShots AI

By using SuperShots AI, you agree to these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By downloading, installing, or using SuperShots AI ("the App"), developed by Alberto Cruz ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. License to Use

2.1 Grant of License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

2.2 Restrictions

You may NOT:

Reverse engineer, decompile, or disassemble the App
Remove copyright or proprietary notices
Use the App for illegal purposes
Attempt to gain unauthorized access to our systems
Share your account credentials with others

3. Subscriptions and Payments

3.1 PRO Subscription

Certain features require a PRO subscription, processed through Apple's App Store.

3.2 Pricing & Models

SuperShots AI operates on a Freemium model:

Free Tier: Free to download and use with limited features (1 AI analysis per day, manual processing only)
PRO Subscription: Unlocks unlimited analysis and additional features
Subscription Plans: Monthly and annual options available
Current Pricing: See the App Store or in-app pricing for current rates

Prices may vary by region and are subject to change. All pricing information is displayed at the time of purchase in your local currency through the App Store.

3.3 Free Trial (PRO)

New subscribers to the PRO plan may receive a free trial (e.g., 7 days). You will not be charged if you cancel at least 24 hours before the trial ends via your Apple ID settings.

3.4 Auto-Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

3.5 Refunds

Refunds are handled by Apple according to their policies. Contact Apple Support for refund requests.

3.6 Cancellation

You can cancel anytime through:

Settings → [Your Name] → Subscriptions → SuperShots AI → Cancel Subscription
Or in-app via Settings → Manage Subscription → Manage in App Store

4. User Accounts

4.1 Account Creation

You may create an account using:

Email and password
Apple Sign-In
Google Sign-In

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately of any unauthorized access.

4.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms.

5. User Content and Data

5.1 Your Data

You retain all rights to your screenshots and images. We do not claim ownership.

5.2 Hybrid Processing Model

How screenshot analysis works:

OCR (Text Extraction): Performed on your device using Apple's Vision Framework
AI Analysis: Your screenshots are compressed (JPEG 60%) and sent to our backend servers, which forward them to third-party AI services (Large Language Models like OpenAI, Google Gemini, or Anthropic) for analysis
Image Storage: Your images are NOT stored on our servers - they are deleted immediately after AI analysis completes (typically 3-10 seconds)
Results Storage: AI-generated descriptions, tags, and categories are stored exclusively on your device using iOS SwiftData
Internet Requirement: An active internet connection is required for AI analysis features

5.3 iCloud Backup (Optional)

You may optionally enable iCloud backup to sync your analysis results (not images) across your devices using Apple's CloudKit service.

5.4 Data Deletion

You can delete your account and all associated data at any time through Settings → Delete Account. This will remove:

Your account information from our database
All locally stored analysis results from your device
iCloud backup data (if enabled)

6. Acceptable Use

You agree NOT to:

Use the App to process illegal or harmful content
Violate any applicable laws or regulations
Infringe on intellectual property rights
Harass, abuse, or harm others
Attempt to bypass subscription requirements
Use the App in a way that disrupts service for others

7. Intellectual Property

7.1 Our Rights

The App, including its design, code, graphics, and trademarks, is owned by us and protected by copyright and trademark laws.

7.2 Feedback

If you provide feedback or suggestions, we may use them without compensation or attribution.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy or reliability of AI-generated results

We do not guarantee that:

The App will be error-free or uninterrupted
OCR results will be 100% accurate
AI-generated descriptions, tags, or categories will be perfect or error-free
Third-party AI services will always be available
All bugs will be fixed

AI Accuracy Disclaimer: AI analysis is performed by third-party Large Language Models (LLMs). While these services are highly advanced, they may occasionally produce inaccurate, incomplete, or unexpected results. Always review AI-generated content for accuracy.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

Indirect, incidental, or consequential damages
Loss of data, profits, or business opportunities
Damages exceeding the amount you paid for the subscription in the last 12 months

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

Your violation of these Terms
Your use of the App
Your violation of any third-party rights

11. Modifications to the App

We reserve the right to:

Modify or discontinue features (with notice)
Update the App to fix bugs or add features
Change subscription pricing (with 30 days notice)

12. Third-Party Services

The App integrates with the following third-party services:

AI Processing: OpenAI, Google Gemini, Anthropic (for screenshot analysis)
Authentication: Apple Sign-In, Google Sign-In
Backend Database: Supabase (for account management)
Cloud Backup: Apple iCloud CloudKit (optional)
Payments: Apple App Store / StoreKit

We are not responsible for the performance, availability, or policies of these third-party services. Your use of these services is subject to their respective terms of service and privacy policies.

13. Governing Law

These Terms are governed by the laws of Spain and the European Union. Disputes will be resolved in the courts of Spain.

14. Dispute Resolution

14.1 Informal Resolution

Before filing a claim, contact us at support@supershots.ai to resolve the issue.

14.2 Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration (except where prohibited by law).

15. Severability

If any provision of these Terms is found invalid, the remaining provisions remain in effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us.

17. Changes to Terms

We may update these Terms. Continued use after changes constitutes acceptance. We will notify you of material changes.

19. Age Requirement

You must be at least 13 years old to use the App. If you are under 18, you must have parental consent.

20. Termination

We may terminate your access immediately if you violate these Terms. Upon termination:

Your license to use the App ends
You must delete the App from your device
Subscription payments are non-refundable unless required by law

By using SuperShots AI, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

1. Aceptación de Términos

Al descargar, instalar o usar SuperShots AI ("la App"), desarrollada por Alberto Cruz ("nosotros", "nuestro"), aceptas estar sujeto a estos Términos de Servicio ("Términos"). Si no estás de acuerdo, no uses la App.

2. Licencia de Uso

2.1 Concesión de Licencia

Te concedemos una licencia limitada, no exclusiva, intransferible y revocable para usar la App con fines personales y no comerciales.

2.2 Restricciones

NO puedes:

Realizar ingeniería inversa, decompilar o desensamblar la App
Eliminar avisos de copyright o propiedad
Usar la App con fines ilegales
Intentar obtener acceso no autorizado a nuestros sistemas
Compartir las credenciales de tu cuenta con otros

3. Suscripciones y Pagos

3.1 Suscripción PRO

Ciertas funciones requieren una suscripción PRO, procesada a través de la App Store de Apple.

3.2 Precios y Modelos

SuperShots AI opera con un modelo Freemium:

Tier Gratuito: Descarga y uso gratuito con funciones limitadas (1 análisis IA por día, solo procesamiento manual)
Suscripción PRO: Desbloquea análisis ilimitados y funciones adicionales
Planes de Suscripción: Opciones mensuales y anuales disponibles
Precios Actuales: Consulta la App Store o la app para tarifas actuales

Los precios pueden variar según la región y están sujetos a cambios. Toda la información de precios se muestra al momento de la compra en tu moneda local a través de la App Store.

3.3 Prueba Gratis (PRO)

Los nuevos suscriptores al plan PRO pueden recibir una prueba gratuita (ej. 7 días). No se te cobrará si cancelas al menos 24 horas antes de que termine la prueba a través de los ajustes de tu Apple ID.

3.4 Renovación Automática

Las suscripciones se renuevan automáticamente a menos que se cancelen al menos 24 horas antes del final del período actual.

3.5 Reembolsos

Los reembolsos son gestionados por Apple según sus políticas. Contacta con el Soporte de Apple para solicitudes de reembolso.

3.6 Cancelación

Puedes cancelar en cualquier momento a través de:

Ajustes → [Tu Nombre] → Suscripciones → SuperShots AI → Cancelar Suscripción
O en la app vía Ajustes → Gestionar Suscripción → Gestionar en la App Store

4. Cuentas de Usuario

4.1 Creación de Cuenta

Puedes crear una cuenta usando:

Email y contraseña
Iniciar sesión con Apple
Iniciar sesión con Google

4.2 Seguridad de la Cuenta

Eres responsable de mantener la confidencialidad de las credenciales de tu cuenta. Notifícanos inmediatamente de cualquier acceso no autorizado.

4.3 Terminación de Cuenta

Nos reservamos el derecho de suspender o terminar cuentas que violen estos Términos.

5. Contenido y Datos del Usuario

5.1 Tus Datos

Conservas todos los derechos sobre tus capturas de pantalla e imágenes. No reclamamos propiedad.

5.2 Modelo de Procesamiento Híbrido

Cómo funciona el análisis de capturas:

OCR (Extracción de Texto): Se realiza en tu dispositivo usando el Framework Vision de Apple
Análisis de IA: Tus capturas se comprimen (JPEG 60%) y se envían a nuestros servidores backend, que las reenvían a servicios de IA de terceros (Modelos de Lenguaje como OpenAI, Google Gemini o Anthropic) para su análisis
Almacenamiento de Imágenes: Tus imágenes NO se almacenan en nuestros servidores - se eliminan inmediatamente después de completar el análisis de IA (típicamente 3-10 segundos)
Almacenamiento de Resultados: Las descripciones, etiquetas y categorías generadas por IA se almacenan exclusivamente en tu dispositivo usando SwiftData de iOS
Requisito de Internet: Se requiere una conexión a internet activa para las funciones de análisis de IA

5.3 Copia de Seguridad en iCloud (Opcional)

Opcionalmente puedes habilitar la copia de seguridad en iCloud para sincronizar tus resultados de análisis (no imágenes) entre tus dispositivos usando el servicio CloudKit de Apple.

5.4 Eliminación de Datos

Puedes eliminar tu cuenta y todos los datos asociados en cualquier momento a través de Ajustes → Eliminar Cuenta. Esto eliminará:

Tu información de cuenta de nuestra base de datos
Todos los resultados de análisis almacenados localmente en tu dispositivo
Datos de copia de seguridad en iCloud (si está habilitado)

6. Uso Aceptable

Aceptas NO:

Usar la App para procesar contenido ilegal o dañino
Violar leyes o regulaciones aplicables
Infringir derechos de propiedad intelectual
Acosar, abusar o dañar a otros
Intentar eludir los requisitos de suscripción
Usar la App de manera que interrumpa el servicio para otros

7. Propiedad Intelectual

7.1 Nuestros Derechos

La App, incluyendo su diseño, código, gráficos y marcas registradas, es de nuestra propiedad y está protegida por leyes de copyright y marcas.

7.2 Comentarios

Si proporcionas comentarios o sugerencias, podemos usarlos sin compensación o atribución.

8. Exención de Garantías

LA APP SE PROPORCIONA "TAL CUAL" SIN GARANTÍAS DE NINGÚN TIPO, YA SEAN EXPRESAS O IMPLÍCITAS, INCLUYENDO PERO NO LIMITADO A:

Comerciabilidad
Idoneidad para un propósito particular
No infracción
Precisión o fiabilidad de resultados generados por IA

No garantizamos que:

La App esté libre de errores o ininterrumpida
Los resultados de OCR sean 100% precisos
Las descripciones, etiquetas o categorías generadas por IA sean perfectas o libres de errores
Los servicios de IA de terceros estén siempre disponibles
Todos los errores se corregirán

Descargo de Responsabilidad sobre Precisión de IA: El análisis de IA es realizado por Modelos de Lenguaje de terceros (LLMs). Aunque estos servicios son muy avanzados, pueden ocasionalmente producir resultados inexactos, incompletos o inesperados. Siempre revisa el contenido generado por IA para verificar su precisión.

9. Limitación de Responsabilidad

EN LA MEDIDA MÁXIMA PERMITIDA POR LA LEY, NO SEREMOS RESPONSABLES DE:

Daños indirectos, incidentales o consecuentes
Pérdida de datos, beneficios u oportunidades de negocio
Daños que excedan la cantidad que pagaste por la suscripción en los últimos 12 meses

10. Indemnización

Aceptas indemnizarnos y eximirnos de responsabilidad por cualquier reclamación, daño o gasto que surja de:

Tu violación de estos Términos
Tu uso de la App
Tu violación de derechos de terceros

11. Modificaciones a la App

Nos reservamos el derecho a:

Modificar o discontinuar funciones (con aviso)
Actualizar la App para corregir errores o añadir funciones
Cambiar los precios de suscripción (con 30 días de aviso)

12. Servicios de Terceros

La App se integra con los siguientes servicios de terceros:

Procesamiento de IA: OpenAI, Google Gemini, Anthropic (para análisis de capturas)
Autenticación: Iniciar sesión con Apple, Iniciar sesión con Google
Base de Datos Backend: Supabase (para gestión de cuentas)
Copia de Seguridad en la Nube: Apple iCloud CloudKit (opcional)
Pagos: Apple App Store / StoreKit

No somos responsables del rendimiento, disponibilidad o políticas de estos servicios de terceros. Tu uso de estos servicios está sujeto a sus respectivos términos de servicio y políticas de privacidad.

13. Ley Aplicable

Estos Términos se rigen por las leyes de España y la Unión Europea. Las disputas se resolverán en los tribunales de España.

14. Resolución de Disputas

14.1 Resolución Informal

Antes de presentar una reclamación, contáctanos en support@supershots.ai para resolver el problema.

14.2 Arbitraje

Si la resolución informal falla, las disputas se resolverán mediante arbitraje vinculante (excepto donde esté prohibido por ley).

15. Divisibilidad

Si alguna disposición de estos Términos se considera inválida, las disposiciones restantes permanecen en vigor.

16. Acuerdo Completo

Estos Términos, junto con nuestra Política de Privacidad, constituyen el acuerdo completo entre tú y nosotros.

17. Cambios a los Términos

Podemos actualizar estos Términos. El uso continuado tras los cambios constituye aceptación. Te notificaremos de cambios materiales.

19. Requisito de Edad

Debes tener al menos 13 años para usar la App. Si tienes menos de 18, debes tener el consentimiento de tus padres.

20. Terminación

Podemos terminar tu acceso inmediatamente si violas estos Términos. Tras la terminación:

Tu licencia para usar la App finaliza
Debes eliminar la App de tu dispositivo
Los pagos de suscripción no son reembolsables a menos que lo exija la ley

Al usar SuperShots AI, reconoces que has leído, comprendido y aceptas estar sujeto a estos Términos de Servicio.
